Complex Litigation
How we manage complex litigation
Litigation expenses can have a major
impact on the bottom line of any business. The high cost of
litigation is often driven by inefficient tasking, including the use
of high-priced lawyers for tasks that could just as easily be
completed by lower-priced lawyers or non-lawyers.
At Spotswood Sansom & Sansbury LLC, we believe that our
lawyers are best utilized in the service of a case’s strategic and
tactical needs, rather than on the rudimentary processing of
documents and other evidence. Therefore, Spotswood Sansom & Sansbury
LLC typically
staffs its cases with two of its own lawyers and ensures that, if
others can perform certain tasks more efficiently, those tasks are
appropriately allocated and supervised.
Some particularly complex cases—such
as those involving a large number of documents, parties, or
witnesses—are incredibly labor-intensive. Spotswood Sansom &
Sansbury LLC has aided
its clients in developing innovative and cost-effective solutions to
such cases. Two of those solutions are described below.
Insourcing: The FedEx Model
In the early 1990s, FedEx predicted
that it would face significant increases in legal expenses in the
coming years. FedEx concluded that the most cost-effective way to
deal with this threat was to employ a large in-house staff of
experienced litigators, devoted full-time to FedEx cases, at half
the cost of outside counsel. This model has enabled FedEx to keep
its litigation expenses among the lowest of companies in the Fortune
500.
While in-sourcing can be a
cost-effective way to deal with cases that are both foreseeable to a
company and familiar to its lawyers, a need for outside support can
occasionally arise. Since April of 2001, when Spotswood Sansom &
Sansbury LLC was
founded, FedEx has turned to Spotswood Sansom & Sansbury LLC to provide this
additional support. Spotswood Sansom & Sansbury LLC works with FedEx to ensure that
responsibilities for the litigation are allocated efficiently
between in-house and outside counsel. Often, extensive preliminary
discussions about this allocation can save enormous costs over the
course of the litigation.

the FedEx Model, please see this

Outsourcing
Though in-sourcing is a
cost-effective solution for large companies that face a significant
amount of litigation, it is not the most cost-effective solution for
every company. But even companies that rely heavily on outside
counsel can make cost-effective use of Spotswood Sansom & Sansbury
LLC’s services. In
labor-intensive cases, Spotswood Sansom & Sansbury LLC is prepared
to outsource those activities that do not require our expertise.
Numerous companies, in the United States and beyond, a well-equipped
to provide top-notch support in processing evidence and performing
other rudimentary legal tasks. These tasks are, of course, performed
under the careful supervision of Spotswood Sansom & Sansbury LLC’s lawyers.
There are, of course, numerous other
ways to reduce legal expenses, and Spotswood Sansom & Sansbury LLC seeks to tailor its
litigation services to the needs of its individual clients and their
individual cases. By creating these solutions, Spotswood Sansom &
Sansbury LLC ensures
that its clients use it for what it does best: Using its extensive
experience and legal skills to resolve complex cases as efficiently
as possible.
