Ken Sansom is an experienced
litigator whose paramount objective is to attain the litigation
goals of each of his clients, whether those goals are victory in
court, cost control, vindication of important legal principles, or
other objectives grounded in the client’s competitive strategy.
Ken’s litigation experiences have
included successful handling of class litigation in state and
federal courts in many different venues, briefing and arguing
appeals—on behalf of both parties and amici—in state and federal
appellate courts (including the United States Supreme Court), and a
variety of commercial and employment litigation in trial courts.
Prior to law school, Ken served as a
submarine officer in the United States Navy, where he was trained in
the theory and operation of nuclear reactors, the tactical
employment of a submarine, and leadership. As a founding member of
his firm, Ken has consistently provided value to his clients in
challenging complex litigation of many varieties. He has achieved a
variety of outstanding results, including:
- Dismissal of significant class
actions in multiple states threatening liability under
consumer-protection laws and common-law theories for certain
transportation charges. The results in these cases have aided
transportation industry participants in ensuring that their
consumer relationships continue to be governed by established and
predictable federal law that can be relied upon with confidence
nationwide.
- Dismissal of business-tort claims
in New York using preemption principles to ensure the ability of a
company to change its vendor relationships when business
circumstances require that such changes be made.
- Clarification by the Alabama
Supreme Court of venue rules whose impact is to prevent
intra-county forum shopping.
- Strategic modifications of
contracts used in a variety of repetitive business circumstances
to better anticipate the litigation environment.
- A successful petition for writ of
certiorari to the United States Supreme Court.
- Industry amicus briefing in
various federal courts of appeal and the United States Supreme
Court.
- Assistance to an in-house legal
department in the development of litigation management systems.
- National coordination of complex
litigation defense.
